Please read this document carefully. It contains the Legal Notice that regulates the access to, browsing and usage of the website hosted at the URL www.thevalleytalent.es (hereafter referred to as the “Website”).

The access to, browsing and usage of the Website imply explicit and unreserved acceptance of all the clauses of this Legal Notice, and constitute a binding agreement between the user and THE VALLEY TALENT.

The observance and compliance of these terms will be enforceable with respect to any person who accesses, browses or uses the Website. If you do not agree with these terms, do not access or use THE VALLEY TALENT Website.

2. SUBJECT MATTER AND SCOPE

This Legal Notice regulates the access, browsing and usage of this Website, notwithstanding that THE VALLEY TALENT reserves the right to modify its appearance, configuration and content, as well as the conditions required to access and/or use it. Any modifications made to the terms and conditions of this Legal Notice will be published in the same way in which they appear or via any other type of communication addresses to the users. Access to and usage of the content of the Website after the amendments or changes are enforced, imply acceptance of them.

However, access to certain content and usage of certain services may be subject to certain special conditions, which will be clearly shown in any case. These special conditions may replace, complete or modify the terms of this Legal Notice, where appropriate. In case of any contradiction, these special conditions will prevail.

3. ACCESS

Access to and browsing of the Website is free of cost and does not require any registration. The access and usage of the Website assumes that the user of the Website accepts this Legal Notice in its entirety and is obliged to fully comply with it, as well as the instructions or suggestions indicated in each particular case throughout the Website.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

THE VALLEY TALENT is the owner or, when applicable, has the corresponding licenses on the rights of exploitation of intellectual and industrial properties of the Website, as well as all its contents, including, but not limited to, the platform itself, texts, photographs/illustrations, logos, brands, graphics, designs, interfaces, and any other information or content, and the services available throughout.

The access, browsing and usage of the Website by the user, or the usage, acquisition and/or contracting of products or services offered through it will not imply a renouncement, transfer, licensing or total/partial release of such rights by THE VALLEY TALENT under any circumstances. The user has the right to use the contents and/or services of the Website within a purely domestic setting and only for the purpose of enjoying the services provided in accordance with this Legal Notice.

The references to registered trademarks or trade names, or other distinctive signs, whether owned by THE VALLEY TALENT or other third-party companies, carry an implicit prohibition on their use without the consent of THE VALLEY TALENT or its legitimate owners. Unless expressly stated otherwise, the access to, browsing or usage of the Website and/or its contents does not give the user any right over the distinctive signs used within the Website, at any point in time.

All intellectual and industrial property rights on the contents and/or services of the Website are reserved and it is particularly prohibited to modify, copy, reproduce, publicly communicate, transform or distribute the entire content included in the Website or a part of it, by any means and in any form, for public or commercial purposes, without a prior, explicit and written authorisation from THE VALLEY TALENT or, where applicable, the owner of the corresponding rights.

The alteration, deletion or manipulation of the copyright indications or other credits that the user finds on the Website that identify the right holder of the content is strictly prohibited. The user agrees to take full responsibility for any communication that is provided personally or under the user’s name, freeing and relieving THE VALLEY TALENT from liability without any restriction with regard to the accuracy, legality, originality and ownership of it.

If the user uses any devices like technical protection devices, fingerprints, or any other protection mechanisms or information incorporated into the content offered on the Website.

In the event that the user sends information of any kind to THE VALLEY TALENT through any of the channels enabled for that purpose, the user declares, guarantees and accepts that they have the right to do so freely and that said information does not infringe any intellectual and/or industrial property right trade secret or any other third-party rights, and that said information is not confidential or harmful to third parties.

Should the user notice the existence of any content that is illicit, illegal, contrary to law or that could be an infringement of intellectual and/or industrial property rights, they must immediately notify THE VALLEY TALENT through the email address info@thevalleytalent.es, so that it can proceed to take appropriate action.

Similarly, in the event that any user or a third party considers that any of the content of the Website owned by THE VALLEY TALENT violates their intellectual and/or industrial property rights as well as any other rights, they must send a message to info@thevalleytalent.es with the following information:

Identification data and contact details of the claimant or the legal representative.
Documentation proving your status as holder of the rights that are allegedly infringed.
Detailed description of the rights allegedly infringed by THE VALLEY TALENT, as well as its exact location within the Website.
Explicit declaration by the claimant that the content has been used without the consent of the owner of the rights allegedly infringed.

5. LINKS

5.1 Links to other websites

In the event that the Website shows links to other websites through different buttons, links, banners, embedded content, etc., THE VALLEY TALENT informs that they are directly managed by third parties. THE VALLEY TALENT does not have the faculty or human or technical means to anticipate, control and/or approve all the information, content, products or services provided by other platforms when links are added to the Website.

Consequently, THE VALLEY TALENT cannot assume any responsibility for any aspects related to the platform or webpage to which a link could be established from the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents in general.

In this sense, if the users have prior knowledge that the activities carried out through those third-party websites are illegal or contravene morality and/or public order, they must immediately notify THE VALLEY TALENT so that it can disable access to the link connecting to those websites.

In any case, the establishment of any type of link from the Website to another third party website shall not imply that there is any kind of relationship, collaboration or dependence between THE VALLEY TALENT and whoever is responsible for the said external website.

5.2 Links to THE VALLEY TALENT channels on other platforms and social networks

THE VALLEY TALENT may make links available to users, via different tools and applications, that allow users to access the channels and pages of the Website that THE VALLEY TALENT maintains on different platforms and social networks belonging to and/or managed by third parties (For example, Facebook, Twitter, Instagram, YouTube, etc.). The inclusion of these links on the Website has the sole purpose of providing users with access to these channels on different platforms and social networks.

The establishment of these links does not imply any relationship between THE VALLEY TALENT and the owner, creator or distributor of the linked platform, nor the acceptance and approval by THE VALLEY TALENT of its contents and/or services, being its owner, creator or distributor solely responsible for them.

In no case does THE VALLEY TALENT share with Facebook, Twitter or any other social network that it incorporates in the future any type of private information about its users, being its only purpose established in this Legal Notice, as well as in the Privacy Policy of the Website. In this sense, all the information that the user wishes to provide to these platforms will be under the user’s own responsibility, not intervening THE VALLEY TALENT in said process.

The activation and use of these links may involve identification and authentication of the user (login/password) on these platforms, completely external to the Website and beyond the control of THE VALLEY TALENT. When accessing these external networks, the user enters an environment not controlled by THE VALLEY TALENT, and so it will not assume any responsibility for the security configuration of those environments.

Since THE VALLEY TALENT has no control over the content hosted on these networks, the user acknowledges and accepts that it does not assume any responsibility for the content or for the services that the user can access on those pages, or for any content , products, services, ads, or any other material available in them. 5.3 Links on other webpages to the Website.

THE VALLEY TALENT does not authorise the adding of a link to the Website from those webpages that contain illicit, illegal, degrading or obscene material, information or content and, in general, that contravene laws, morals, public order, or generally accepted social norms.

However, users may add links to the Website on their websites, provided that they meet the following conditions: a) the link may not reproduce the content of the Website or parts thereof in any form; b) neither a browser nor a border environment shall be created on the sections of the Website, nor can the Website be modified in any other way; c) it is not allowed to make false, inaccurate or incorrect statements or indications about the Website and/or, particularly, declare or imply that THE VALLEY TALENT has authorised the link or that it has supervised or assumed in any way the contents or services offered or made available on the website where the link is established; d) the website on which the link to the Website is established must not contain any information or content that are illegal, contrary to morality and generally accepted norms and public order, nor must it contain any content infringing third party rights, including intellectual and industrial property rights and/or the right to honour, personal or family privacy or to one’s own image or any other right or content contrary to the regulations governing the protection of personal data.

THE VALLEY TALENT does not have the faculty or human or technical means to know, regulate or approve all the information, content, products or services provided by other websites that have established links to the Website. THE VALLEY TALENT does not assume any responsibility for any aspect related to the webpages that establishes links to the Website, specifically, as an example but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents in general.

6. RULES OF USAGE OF THE WEBSITE

Accessing or using the Website for illegal or unauthorised purposes is not permitted, with or without economic intentions and therefore, the consequences will be the sole responsibility of the user. In particular, it is prohibited to (the following list not being absolute):

Use the Website in any way that may cause damage, interruptions, inefficiencies or defects in its own operation or in the computer of a third party;
Use the Website for transmission, installation or publication of any virus, malicious code or other harmful programs or files;
Use the Website to transmit advertising or promotional material, including spam, chain emails or similar;
Use the Website in a manner that violates the rights of THE VALLEY TALENT or any other third party;
Use the Website to transmit or publish any material of a defamatory, offensive, racist, vulgar, denigrating, pornographic, obscene or threatening nature or that may cause discomfort to any person;

Use the Website illegally, against good faith, morals and public order;

Failure to comply with any of the above conditions by the user may entail the adoption of necessary measures by THE VALLEY TALENT without giving the user any right to compensation.

Similarly, the Website has sections where users can participate, publish their own content and/or share content that are their own or published by THE VALLEY TALENT. These sections may be owned by THE VALLEY TALENT and therefore dependent and controlled by it, or outside it, in the case of independent social networks outside of our organisation, for which THE VALLEY TALENT cannot be held responsible, nor for the proper functioning or the conditions and policies set forth by those responsible, the user himself who must consent and always assume the treatment that is carried out on the information published on those platforms.

In any case, we would like to inform you that, by participating in any of these sections, the rest of the users of the Website may access and use all the content published by the user. THE VALLEY TALENT cannot control what use other people will make of those contents and, therefore, is not responsible for it. THE VALLEY TALENT recommends that you do not publish personal data or materials protected by intellectual and industrial property rights or any other rights.

In order to make the Website a safe environment and to protect our users, it is strictly prohibited to publish content:

That may be considered as a violation in any form of the fundamental rights to honour, personal and family privacy or to self-image of third parties and minors;
That includes photographs and that which collect images or personal data of third parties without having obtained the appropriate consent of their owners;
That violates the secrecy of communications or that involve an infringement of intellectual and industrial property rights or of the regulations governing the protection of personal data;
Containing any material or information that is illegal, racist, obscene, pornographic, abusive, defamatory, deceptive, fraudulent or contrary to morality or public order in any way;
That contain “spam” and/or links to sites totally unrelated to the topic or subject;
That includes advertising or promotional communications, for sending advertising messages or for collecting data for the same purpose.

The users who violate these conditions will be responsible for any consequence that occurs as a result. Even if there is no claim from a third party, THE VALLEY TALENT reserves the right to prevent access to the Website or participating spaces enabled therein to users who breach these conditions.

THE VALLEY TALENT does not control the content published by users on the Website and assumes no responsibility for these contents. However, THE VALLEY TALENT reserves the right to supervise and/or moderate any content published by users and to edit or delete it, if it violates this Legal Notice or the Website’s Privacy Policy.

Similarly, if you find any information or content on the Website that may not be appropriate, contrary to current regulations or to the conditions set forth in the Website, please make it known immediately to THE VALLEY TALENT via the different means of contact.

7. RESPONSIBILITIES AND GUARANTEES

THE VALLEY TALENT cannot guarantee absolute reliability, usefulness or authenticity of all the information and/or services of the Website, nor of the usefulness or authenticity of the documentation made available through it.

Consequently, THE VALLEY TALENT does not guarantee nor is responsible for: (i) the continuity of the contents of the Website; ( ii ) the absence of errors in those contents; ( iii ) the absence of viruses and/or other harmful components on the Website or on the server that hosts it; ( iv ) the invulnerability of the Website and/or the impossibility of cracking the security measures adopted therein; (v) the lack of utility or performance of the contents of the Website; and (vi) the damages or losses caused, to the user or to a third party, by any person who violated the conditions, norms and instructions that THE VALLEY TALENT establishes on the Website or through the violation of the security systems of the Website.

Nonetheless, THE VALLEY TALENT declares that it has taken all necessary measures, within its capabilities and state-of-the-art technology to ensure proper functioning of the Website and minimise system errors, both technically as with the contents published on the Website, as well as to prevent presence and transmission of viruses and other harmful components to the users’ computer systems.

THE VALLEY TALENT does not guarantee the legality, reliability and usefulness of the content provided by third parties through the Website. If the user is aware of the existence of any content that is illicit, illegal, contrary to the law or that could be a violation of third party rights, they must immediately notify THE VALLEY TALENT so that it can proceed to take appropriate actions.

THE VALLEY TALENT will not be responsible for the authenticity, integrity or maintenance of the information published on the Website from sources outside it, nor for those contained in other platforms to which there are links in the Website. THE VALLEY TALENT will not assume any responsibility for hypothetical damages that could be caused by the use of the aforementioned information.

8. COMMUNICATION CHANNEL

THE VALLEY TALENT has a channel for its users through which they can communicate and inform about the existence of any content which the user considers as contrary to the law or to be violating the legitimate rights of third parties.

9. SUSPENSION OF THE WEBSITE

THE VALLEY TALENT reserves the right to suspend, modify, restrict or interrupt the access, browsing, usage, hosting and/or download of the content and/or use of the Website’s services, either temporarily or permanently, with or without prior notification, to users who contravene any of the provisions mentioned in this Legal Notice, without any right for the user to demand compensation for this reason.

10. CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of the General Data Protection Regulation (EU) 2016/679 and the Organic Law 3/2018, of Protection of Personal Data and Guarantee of Digital Rights, all personal data provided while using the Website will be processed in accordance with the provisions of the Privacy Policy.

11. GENERAL

The headings of the different clauses are merely informative and will not affect, qualify or encourage interpretation of this Legal Notice. Similarly, THE VALLEY TALENT may modify the terms and conditions specified here, in whole or in part, by publishing any change in the same format as this Legal Notice or via any other type of communication aimed at the users.

Therefore, the temporary validity of this Legal Notice coincides with the duration of its exposure, until it is totally or partially modified, at which point of time, the modified Legal Notice will become effective.

Regardless of the provisions of the special conditions that may be established, THE VALLEY TALENT may terminate, suspend or interrupt access to the contents of the Website at any time and without prior notice, without any right for the user to demand compensation. After the said termination, the prohibitions on the use of the contents mentioned in this Legal Notice will remain in force.

Similarly, if the user breaches this Legal Notice, THE VALLEY TALENT may suspend or delete his profile automatically and without prior notice, and in no case such suspension or deletion would give the user the right to any compensation. For these purposes, THE VALLEY TALENT would like to inform that it will be able to collaborate with the competent police and judicial authorities as needed, if it detects any infraction of the current legislation or if it suspects committing of any crime.

The use of any product and/or payment service offered by THE VALLEY TALENT through the Website will be regulated by the general and/or special conditions of each specific service provided for this purpose.

In case of any discrepancy between what is established in this Legal Notice and the special conditions of each specific service of the Website, the provisions of the latter will prevail.

In the event that any particular provision in this Legal Notice was declared void or unenforceable, in whole or in part, by any Court, Tribunal or authorised administrative body, the said nullity or non-application shall not affect the remaining provisions of this Legal Notice.

The non-exercise or non-execution of any right or provision contained in this Legal Notice by THE VALLEY TALENT shall not mean a waiver of the same.

12. APPLICABLE LAW AND COMPETENT JURISDICTION

The regulations in force will determine the governing laws and the jurisdiction that should recognise the relation between THE VALLEY TALENT and its users. However, since such regulations allow the possibility for the parties to approach a specific jurisdiction, for any litigious issue arising from or related to this Website, the Spanish legislation in force at the time of the dispute will apply. Similarly, THE VALLEY TALENT and its users, explicitly renouncing any other jurisdiction that may apply to them, shall approach the Courts and Tribunals of Madrid.
